Over the last year, the Biden Administration as issued executive orders and policies to reverse the Trump Administration’s attacks on federal unions and affirm federal employees’ union rights.

Unfortunately and shockingly, the Trump-appointed majority on the Federal Labor Relations Authority stands in the way of President Biden’s commitment to workers’ rights and rescinding the Trump Administration's anti-union actions against federal employees.

While President Biden has nominated two highly qualified FLRA board members and an FLRA General Counsel— including current FLRA Chair Ernest DuBester, an experienced and fair voice of reason on the FLRA — these nominations are awaiting confirmation by the U.S. Senate.

One of the President’s FLRA nominees, Susan T. Grundmann, can be confirmed immediately and doing so would remove an anti-union FLRA board member .

The failure to confirm the FLRA nominees continues to put federal employees’ collective bargaining rights at risk. Without a functional and fair FLRA, the Biden Administration’s efforts to advance an agenda that supports federal workers and federal sector labor rights will continue to be at the mercy of an ideological and anti-union FLRA that is a relic of the last administration.

The failure to confirm Federal Labor Relations Authority nominees is putting federal workers collective bargaining rights at risk. Without a functional and fair FLRA, the Biden Administration’s efforts to advance a pro-union labor-management relations in the federal sector will continue to be at the mercy of a Trump-appointed anti-union FLRA that is a relic of the last administration.

 Tell your Senators to prioritize and confirm these nominees immediately.


Just last month, two FLRA members that comprise an anti-union majority on the FLRA issued a decision against the union rights of immigration judges who work for the Department of Justice (DOJ) and are represented by the National Association of Immigration Judges - IFPTE Judicial Council 2 (NAIJ). This union busting effort to silence nonsupervisory immigration judges by erroneously classifying them as “management officials” and decertify their union began in 2019 under Attorney General William Barr.

In June and July of 2021, the DOJ reversed their policy, filed a motion to withdraw the 2019 petition that stared the union busting effort — but despite the DOJ supporting the immigration judges’ union rights, THE FLRA CONTINUED THE ANTI-UNION EFFORT !

IFPTE members aren’t the only federal workers whose union rights are in danger because of Senate inaction on confirming FLRA nominees. Over the last four years, the anti-union ideologues on the FLRA have undercut the labor board’s validity and credibility.

The solution is simple: the Senate must confirm these FLRA nominees as soon as possible.
